Yesterday I shared a few images from some of my favorite editorial assignments from 2012. Today is all about LOVE! Over the past year I had the opportunity to share in the love of several amazing couples, through engagement sessions and some wonderful and fun wedding ceremonies. I want to thank each and every couple for helping make it such a successful year. There is no higher complement that I can receive beyond a referral and I want to thank those of you who have recommended me to other brides. 2013 is already shaping up to be as joyous and exciting as 2012!

Best of 2012: Savannah Editorial Photography

2012 has been an amazing year for me in so many ways. Since it would be impossible for me to highlight everything in one blog I have decided to split things up a bit. Today I am starting with some of my favorite editorial and commercial photos from the past year. Aside from my regular work for the Savannah Morning News I was blessed to be given the opportunity to produce work for several other publications. While I enjoyed photographing assignments for organizations like the New York Times, Associated Press Images, and Washington Times I would count the work I produced for local non-profit organization Step-up Savannah as one of my favorite projects from the year.

New Terms of Use for Instagram

Yesterday’s release of the new Instagram Terms of Service has revived the debate about how Social Media outlets are cashing in on user content. Sharing your thoughts and images is easier than ever. However it is also easy for others to gain access to your images. During hurricane Sandy media outlets were asking Twitter users for permission to use their images. Twitter already has a generous license agreement, which can be found in their Terms of Service:

 5. Your Rights

You retain your rights to any Content you submit, post or display on or through the Services. By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).

 You agree that this license includes the right for Twitter to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations or individuals who partner with Twitter for the syndication, broadcast, distribution or publication of such Content on other media and services, subject to our terms and conditions for such Content use.

 Such additional uses by Twitter, or other companies, organizations or individuals who partner with Twitter, may be made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services.

So while you retain copyright you grant others the rights to repost your images. If a media out let comments on your image asking for permission and you grant it without asking for a contract or compensation your image will then likely be spread world wide on tv, the web, and newspapers, often with the media outlet receiving the credit for the image as the source. In today’s world of fast paced information gathering this can be an important part in the dissemination of information during breaking news stories such as aftermath of a major storm.

Istagram is taking this even further. Their new Terms of Use, which will take effect January 16, 2013, gives them the ability to use your photos, username, likeness, and associated information for advertising purposes.

Rights

 

  1.                            Instagram does not claim ownership of any Content that you post on or through the Service. Instead, you hereby grant to Instagram a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service, except that you can control who can view certain of your Content and activities on the Service as described in the Service’s Privacy Policy, available here:http://instagram.com/legal/privacy/.
  2.                            Some or all of the Service may be supported by advertising revenue. To help us deliver interesting paid or sponsored content or promotions, you agree that a business or other entity may pay us to display your username, likeness, photos (along with any associated metadata), and/or actions you take, in connection with paid or sponsored content or promotions, without any compensation to you. If you are under the age of eighteen (18), or under any other applicable age of majority, you represent that at least one of your parents or legal guardians has also agreed to this provision (and the use of your name, likeness, username, and/or photos (along with any associated metadata)) on your behalf.
  3.                         You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.

 

So without you knowing it your images might be used for advertising purposes. There is no way for you to know if that next vacation photo you take of your family might just be used to help make Facebook and Instagrm more money. Children are not immune from this either. While there is a Privacy Policy regarding children in place:


6. CHILDREN’S PRIVACY

Instagram does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Service. The Service and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. 

If the child is 13 or older and has an account it is assumed that they have parental consent and therefore their information can be used as well.

With so many phones now armed with quality cameras it only makes sense that media organizations and advertisers are looking to tap into the wealth of imagery that is being produced and shared around the world. Many will not care about the new Terms and will continue to use the social media outlets without concern. If however you do not wish to have your information shared then you should cancel your accounts before January 16. If you don’t mind, and many will not, then you can continue what you’re doing. As with any social media sharing I always think about my reasons for utilizing the service. If I am a business and I am sharing content in order to get more recognition then I will likely not mind if my information and images are used. Perhaps I will just be mindful of the imagery I share, avoiding photos of my family and children.

Social Media is a fun way to share your creativity with others but you should always make an effort to be aware of the current Terms of Service or Terms of Use that you are sharing under.
